Design Partner Agreement
This Design Partner Agreement governs your participation as an independent design partner on the VLCANO platform. Free to upload. Keep 80% of every sale. By completing the design partner registration process and uploading designs, you agree to be bound by this agreement.
1. Design Ownership
You retain copyright ownership of all original designs you upload to VLCANO. By uploading a design to the platform, you grant VLCANO an exclusive license to display, reproduce, and sell products featuring your design through the VLCANO marketplace.
2. Platform Exclusivity
Designs submitted to the VLCANO marketplace are listed exclusively on VLCANO. You agree not to list the same designs for sale on competing print-on-demand marketplaces while they are active on VLCANO. You may continue to use your designs for personal projects, portfolio display, or non-commercial purposes.
3. Royalties
You earn 80% of every sale of a product featuring your design. VLCANO retains 20% as a platform fee. There are no monthly fees, subscription tiers, or upload charges. Royalties are paid by PayPal as soon as the customer pays for an order that uses your design; they are not held. No royalty is earned when you order your own design for yourself. If an order is cancelled or refunded, VLCANO may deduct that royalty from your future royalties.
3a. Custom Design Fees
When a customer hires you for a custom design, they pay the design fee to VLCANO up front, and you appoint VLCANO as your limited agent to collect it: the customer's payment to VLCANO counts as payment to you. VLCANO holds the fee until the customer approves one of your proofs, then releases 80% of it to you by PayPal (VLCANO keeps 20%). If the customer cancels before you send any proof, the fee is refunded to them. If either of you asks VLCANO to step in, the fee stays on hold while VLCANO reviews the request and the proofs, and VLCANO may release it to you, refund the customer, or split it. Once a proof is approved and paid, the customer owns the approved design and may download and reuse it.
4. Content Standards
All designs must be your own original work. You may not upload designs that: infringe on the intellectual property, trademark, or copyright of any third party; include unlicensed logos, brand marks, or recognizable likenesses of real individuals without consent; or violate any applicable law. VLCANO reserves the right to remove designs that violate these standards.
5. Design Removal
You may request removal of your designs from the marketplace at any time. Designs cannot be removed from orders that are already in production or fulfilled. Upon removal, the exclusivity obligation for that design ends.
6. Termination
VLCANO reserves the right to suspend or terminate your design partner account for violation of this agreement, submission of infringing content, or any conduct deemed harmful to the platform. Pending royalties for fulfilled orders will be paid out upon account closure.
